HOW TO DRAFT BILLS. More than 80 delegates from over 27 schools as well as online viewers participated in the two-day seminar the House of Representatives held on Wednesday to kick off this year’s Bill Drafting Contest. The seminar tackled basic principles and steps in crafting bills, including the role of the House committees in the legislative process. Participants were also given the option to take advantage of mentorship and consultations to help them prepare their entries for this year’s bill drafting tilt. Submission of entries starts on July 16 and ends at 7:00 p.m. of August 16, 2018.
TROUBLED WATER. The House committee on Metro Manila development chaired by Rep. Winston Castelo on Tuesday conducted hearings on two important issues — the status of the Laguna Lake Development Authority’s (LLDA) water filtration project and management affecting the ecology and the quality of water supply in Metro Manila; and the reportedly poor service and mismanagement of cable TV connection/subscription service in Metro Manila. With Castelo were Reps. Bayani Fernando, Jose Christopher Belmonte, and Francisco Datol, Jr.
House to LLDA: Ensure safe water for consumers
The House committee on Metro Manila Development on Tuesday directed the Laguna Lake Development Authority (LLDA) and the Environmental Management Bureau-Department of Environment and Natural Resources (EMB-DENR) to ensure clean, safe and potable water supply for Metro Manila residents, particularly those living near the lake.
In a hearing presided by its chairman Rep. Winston Castelo, the committee pried into the status of the LLDA’s water filtration project and management, particularly its impact on the ecology and the quality of water supply.
LLDA officials admit that unabated discharge of waste water into the Laguna Lake by nearby establishments pose risk to the quality of water supply in Metro Manila and adjacent areas.
Laguna Lake is now a major resource that supplies the domestic water requirement of the nearby cities and towns along the lake. This was made possible by LLDA Board Resolution 338, series of 2007 allowing extraction of lake waters subject to the grant of permits.
Permit for Manila Water Services Inc. (MWSI) to extract a maximum volume of 300,000 cubic meters per day has been approved in July 2009.
But according to LLDA’s own estimate, about 40 percent of establishments that obtained permits do not comply with Republic Act 9275, also known as the “Philippine Clean Water Act.”
The law requires all establishments, industrial parks, and factories to have centralized water plants. LLDA records show majority of the violators are quick-service restaurants.
LLDA officials complained of lack of manpower to conduct the necessary annual inspections of establishments within their jurisdiction, noting the authority has only 20 inspectors tasked to check into the compliance of around 10,000 establishments.
To address the problem, the committee proposed segregation of authority between LLDA and the EMB of the DENR-National Capital Region to guarantee adequate inspection and proper management of the concerned establishments.
In addition, Rep. Francisco Datol suggested that the LLDA and EMB-DENR also coordinate with local government units (LGUs) for their assistance. But he said it is necessary also to strengthen existing laws and increase the penalties for violators.
Castelo said the two agencies must be strict in implementing the law and issue closure orders to non-complying institutions. He said they should be held liable and meted appropriate punishments to ensure adherence to the laws.
“Water is a basic necessity. It should be safe and potable. Otherwise, Metro Manila residents will face tremendous problems, especially health issues. This is something that we want to avoid: an epidemic of this magnitude,” said Castelo.
Rep. Bayani Fernando, former chairman of the Metro Manila Development Authority (MMDA), maintained that it would be more efficient if concerned parties would “treat the water systems one at a time.”
The committee said LLDA must step up its effort to improve the present system to carry out its mandate.
Among the resource persons present were Ireneo Bongco, LLDA senior science research specialist; Engr. Emiterio Hernandez, LLDA department manager; and Diosdado Doctor, chief of the DENR-NCR Environmental Monitoring and Enforcement Division.
ERC BILLS. The joint technical working group of the committees on government reorganization, and energy on Monday tackled three important measures which seek to reorganize the energy sector. These are House Bill 5020 entitled "Abolishing the Energy Regulatory Commission (ERC), creating for the purpose the Board of Energy as an attached agency of the Department of Energy", authored by Speaker Pantaleon Alvarez; HB 5961 entitled "Enhancing the governance structure of the ERC" by Rep. Wes Gatchalian; and HB 7104 entitled " Streamlining the regulatory commission on energy, renaming the ERC into the Philippine Power Regulatory Commission, amending for that purpose RA 9136, otherwise known as the Electric Power Industry Reform Act of 2001, appropriating funds thereforseeking to amend the EPIRA Law of 2001 by streamlining the Regulatory Commission on Energy into the Philippine Power Regulatory Commission" by Rep. Lord Allan Jay Velasco. The hearing was attended by officials from the ERC headed by its chairperson, Agnes Devanadera, and representatives of the Department of Budget and Management (DBM), Civil Service Commission (CSC), National Power Corp. (NPC), National Electrification Administration (NEA), and Manila Electric Co. (Meralco).
STRONGER LAW VS. TERRORISM. The technical working group (TWG) of the House committees on public order and safety, and on national defense and security headed by Rep. Rufino Biazon yesterday continued its deliberation on the draft substitute bill of Houses Bill 7141 and 5507 authored by Reps. Romeo Acop and Amado Espino, respectively. The measure seeks to amend Republic Act 9372, also known as “Human Security Act of 2007” in order to strengthen the government addressing the threat of terrorism. Resource persons from the Department of Labor and Employment (DOLE), Free Legal Assistance Group (FLAG), Anti-Money Laundering Council (AMLC), as well as Dean Pacifico Agabin, have provided inputs to the proosal and expressed support for the immediate passage of the measure.
LET PNP AND AFP BODIES PROCEED WITH INVESTIGATION INTO SAMAR MISENCOUNTER - RUFFY BIAZON
It causes me deep sadness to receive news about the misencounter between elements of the Philippine National Police and a unit of the Philippine Army where six policemen lost their lives with several others wounded. Whenever lives of our men in uniform are lost in the performance of their duty, most especially in an instance like this that could have been avoided, I cannot help but feel a sense of personal loss due to the deaths.
Standard operating procedures, rules of engagement and other measures are supposed to be in place precisely to avoid incidents such as this misencounter. Therefore it cannot be avoided that an inquiry should be conducted to determine what went wrong and if there is anyone that should be held accountable.
Therefore, it is crucial that the investigative bodies created by the PNP and AFP be given the free hand and autonomy to look into the reasons, causes and identification of those responsible for the unfortunate misencounter within units of government forces.
We should give these investigators the chance and support for them to perform their duty and mandate not only to determine the facts but also give justice to the fallen.
I call on these investigators to leave no stone unturned and let no sacred cows get away with accountability whatever rank they may be. They should also do their work in the quickest means possible without sacrificing the quality and integrity of their investigation.
To the leadership of the AFP and PNP, I expect them to utilize the legal means available to them to prosecute those who will be determined to have been liable for the misencounter.
The legislature will be awaiting the results of the findings of the investigation to make an evaluation if an inquiry in aid of legislation is necessary to provide legislative measures to prevent a recurrence of operational mishaps.
PH EXPORTS FALLING, HIGH RISK OF JOBS LOSSES COULD LIE AHEAD - RON SALO
(Exports diversification urgently needed)
First, I commend NEDA Secretary Ernesto Pernia for his honesty. “Our latest exports numbers (April 2018) have not been so good. All products showed negative growth rates, except mineral and forest products, as well as electronics,” NEDA Secretary Ernesto Pernia he recently said.
Negative growth rates were nearly across the board through the types of exported goods. However, the dismal foreign trade figures of April are just part of the bad news we must accept and then address.
Growth rates of our total exports have been falling since October last year and on a clear downtrend since at least April 2017.
We now find ourselves in a triple whammy situation - decrease in exports, increase in imports, and depreciation of peso.
It is imperative that we arrest this decline. Too many jobs depend on our export sector. Our economy cannot afford the loss of tens of thousands of jobs if the negative growth persists.
We must urgently find new export markets and focus more on goods that are ranked 11th to 30th.

Africa, Korea, Eastern Europe, some of the former Soviet republics, UAE, Bahrain, and the Caribbean are the major new exports frontiers for the Philippines. We must boost our exports to these countries because they are either fast-growing or highly import-dependent or both.
As to export goods, the top ten commodities have seen better days. The future is in those products that are currently below top 10. There the growth lies.
We must also leverage our special abilities as a people. Filipinos are strong in software development, animation, financial services, legal services, health informatics, and engineering. The fast-growing economies of the world need our products and services in these fields of expertise.
To grow in these markets, we need a strong, bold, and missionary fervor. We need topnotch trade attaches, daring trade missions, and the best, creative minds of the current and new generation of Filipinos. We must send them all out bringing the best of our proudly Philippine-made products and high-value services.
Our export manufacturing sector must accept, adapt, and adjust to the realities of the new world economic order.
The old ways of doing things, even though they have worked well before, would not be as effective now and in the future.
We call on our economic managers to find ways to address these concerns. Sayang ang magagandang natamo ng kasalukuyang administrasyon kung hindi matutugunan ang mga hamong ito.
Pantawid Pasada Program To Serve as Lifeline of Ailing Jeepney Drivers - Sherwin Tugna
Given the consistently high fuel prices all over the country, I commend the Department of Finance, Department of Transportation, and the Land Transportation Franchising and Regulatory Board for coming together for the implementation of the Pantawid Pasada Program.
Section 82 of the Tax Reform for Acceleration and Inclusion (TRAIN) Law clearly states that a social welfare benefit program will be implemented where qualified franchise holders of public utility jeepneys are entitled to fuel vouchers. The fuel subsidy program, once effectively rolled out, would help our drivers cope with the soaring prices of diesel fuel.
Our jeepney drivers serve as a vital component in our transportation sector. It is only befitting that the government extend all the necessary aid to augment their income.
I also urge the leadership of the DOTr to examine if the P5,000 subsidy is enough to sustain our drivers for 6 months amid the rising prices of commodities brought about by the TRAIN Law. Likewise, we in the House of Representatives will do our part and look for viable options to help alleviate the problems of our ailing transport sector.
PROPOSED PHILIPPINE POWER COMMISSION NEEDS COMMISSIONERS OF VARIED EXPERTISE, BACKUP PROVISIONS FOR VACANCIES - CARLOS ROMAN UYBARRETA
Commission to replace ERC
The House Committee on Energy and Committee on Government Reorganization tasked a joint technical working group to produce a consolidated bill with House Bill 7104 (Philippine Power Commission Act) as the lead bill. The PPC is intended to replace the Energy Regulatory Commission and will have upgraded powers compared to the ERC.
HB 7104 was filed by Rep. Lord Allan Jay Velasco. I serve as co-chair of the TWG with Rep. Mark Aeron Sambar as my counterpart from the Committee on Government Reorganization.
I agree with the HB 7104 goal of increasing the membership of the proposed PPC to nine from the current five (including the chairman) of the ERC. This will definitely lighten the workload of the commissioners and get work done faster.
Increasing the number will make the PPC less vulnerable to depletion of its membership by such things as resignation, disability or Ombudsman suspension orders.
As a backup mechanism to vacancies in the PPC, my suggestion is to authorize the commission en banc to designate the PPC executive director as acting commissioner.
If another vacancy occurs, the commission en banc may designate another acting commissioner from among the career officials of the PPC. Acting commissioners shall sit for six months.
To permanently fill vacancies, we need a provision authorizing the President of the Philippines, upon recommendation of the Energy Secretary, to appoint new commissioners to serve the unexpired terms.
I also agree that we should have a PPC with distinguished experts in law, accountancy, engineering and economics.
I am for a strong, independent and transparent regulatory and HB 7104 strengthens, expands, and improves the present ERC.
LOW FEDERALISM AWARENESS CALLS FOR HIGHER BUDGET - REP JB BERNOS
Administration lawmaker Rep. JB Bernos of Abra calls on the Department of Interior and Local Government (DILG) to conduct more intensive campaigns on federalism amid low awareness of Filipinos on the proposed shift to federalism as per Social Weather Station (SWS) Survey.
“While the machinery of the administration is clearly doing its job to push for a federal form of government, there is a need to double our efforts to sway the peoples’ perception of the proposal,” Bernos furthered. “Maybe we should look into increasing the budget of the DILG to expand its efforts in conducting discussions for federalism throughout the country.”
Bernos, member of the House Committee on Local Government, urged more politicians, academics, and civil society organizations to intensify information campaigns on the topic of federalism and how it will positively affect the lives of all Filipinos.
“There is a need for all sides – administration or opposition – to raise the discourse and create conversations with various sectors,” Bernos said. “Let the people learn how federalism will be beneficial for their own ends.”
The lawmaker also enjoins the Department of Education to push for a more thorough teaching of political systems in elementary and secondary schools, believing that early awareness of the subject matter will be crucial in raising support.
“The scientific study of our institutions should be strengthened in the students’ formative years, so that they will have greater appreciation of our work in public service,” Bernos said.
On Thursday, a survey by polling firm Social Weather Stations found out that 1 in 4 Filipinos are aware of the planned shift to federalism, while the others have only heard of it during the period the survey was conducted.
SWS also correlated the support for federalism to the peoples’ trust in President Duterte, whose 2016 campaign included promise to shift to federalism to give more power to regions away from “Imperial Manila”.
